Residential Covenants

Property Services - Residential Covenants Relaxation

  • There are a number of properties within Bedford Borough (formerly owned by the Council or built on land that the Council owned), that are affected by covenants attached to their freehold title that restrict the use and certain types of development that their owners may carry out.
  • In most (but not all) circumstances the Council may be prepared to relax these covenants subject to the payment of an administration fee.
  • When the need for a relaxation of the covenant(s) arises, the Property Services Department will identify whether the application is in respect of works, activities or changes to be carried out or is, in fact, retrospective.
  • The Property Services Department will investigate whether the proposed relaxation of covenant is acceptable to the Council and if it is, they will write to the property owner, advising them of their current or intended ‘breach’, request plans identifying the proposed works and the relevant administration fee.
  • When the relevant fee is paid, the Property Services Department will issue a letter confirming that the Council has consented to the relaxation of the covenant.
  • If the fee is not paid, the covenant is not relaxed.

 

Fees

 

The administration fees with effect from 1 January 2017 are:

 

Relaxation of covenant in advance of proposed works

£106.25 + VAT (£127.50)

Retrospective consent

£210.57 + VAT (£252.70)

Fast Track (response within one working day)*

£314.99 + VAT (£378.00)
