I can confirm that the information you requested is held under the Freedom of Information Act 2000. However, the Freedom of Information Act 2000 does not oblige the Council to comply with a request for information if it estimates that the cost of complying with the request would exceed the “appropriate limit.”

This appropriate limit has been set in the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 which provides that for a local authority the appropriate limit is £450. This is calculated by reference to a maximum of 18 hours being taken and the cost of staff time being set in the Regulations as £25 per hour.  The Regulations also say that In calculating the amount the Council may, “for the purpose of its estimate, take account only of the costs it reasonably expects to incur in relation to the request in: (a) determining whether it holds the information, (b) locating the information, or a document which may contain the information, (c) retrieving the information, or a document which may contain the information, and (d) extracting the information from a document containing it.”

The Council has therefore decided to refuse your request with regards to Part A of your request, please see explanation below.

Response: Extremism isn't one of the official DfE categories, as a result is not recorded on our case management system (AzeusCare).   In order for us to obtain this information would require is to go through 1,000s of referrals manually to check for elements of extremism, to do this would exceed 18 hours.

b) How many Prevent coordinators work for the authority? If this number has increased over the past 4 years, please indicate when and how many additional coordinators were recruited.

What are the lengths of the grace and observation periods that Bedford Council’s CEOs are advised to apply for (i) parking bays, (ii) parking on yellow lines (of all sorts), and (iii) parking in disabled parking bays ?

A grace period is a period of time a vehicle is allowed to park in contravention without incurring a Penalty Charge Notice.  The only grace periods given in Bedford are:

•   10 minutes parking after expiry of paid for time (P&D) bays

•   10 minutes parking after expiry of time in timed disabled bay

Observation periods are given for the following contraventions:

·    5 minutes observation given for parked in a residents' or shared use parking place or zone without either clearly displaying a valid permit or voucher or pay and display ticket issued for that place, or without payment of the parking charge

·   3 minutes observation given for parked in a restricted street during prescribed hours

·    Nil observation period given for parked or loading / unloading in a restricted street where waiting and loading / unloading restrictions are in force

We do not hold this information.  The Council transferred all of its housing stock to BPHA (previously known as Bedfordshire Pilgrims Housing Association) in 1990.  BPHA may be able to assist in providing the information you have requested.

Please can you tell me how many children are receiving any Applied
Behavioural Analysis (ABA) provision - whether it is provided in an
ABA/VB* home programme, in an ABA/VB primary or secondary special
school or alongside mainstream school at any age in a part-time
home/school programme. *ABA is sometimes called VB or Verbal
Behaviour.
Please can you then tell me how many of them had Applied
Behavioural Analysis due to a tribunal order and how many receive
this without a tribunal. If without a tribunal, had parents
initiated legal action but reached settlement with you for ABA
before tribunal took place?
Please can you forward me any policy documents that are associated
with the awarding of any Applied Behavioural Analysis provision and
demonstrate how the decision is made.
Finally, please can you explain your rationale for awarding Applied

Answer: We do not have a policy document on the awarding of ABA. We do have a mechanism by which we can consider such requests and this can be accessed on the Local Offer website for the Authority

e. What procurement route do they use for this, is there a preferred framework? It was a tender exercise through the Commercial Hub & Crown Commercial Services (government framework).
2.Broadband
a. What Provider of Broadband are you using? BT for wifi and JISC for corporate.
b. What is the date for the Contract for Broadband Renewal? BT is 12 months to start with, then 30 days’ notice (rolling contract).  JISC - there is a Memorandum of Understanding (MOU) Agreement in place with a consortium, which we are a member of.
c. What is the Current Cost of the Broadband? £159,000
d.What procurement route do they use for this, is there a preferred framework BT– we just order as required as the initial order will be under £500. JISC – we get this as part of the consortium.

Please provide your Council’s response as to whether Mandatory Charitable 80% Relief would be granted to an Independent School where the Ratepayer is a Limited Liability Partnership (LLP) and annual profits are shared between three Partners.

I am writing in respect of your recent enquiry for information held by the Council under the provisions of the Freedom of Information Act 2000.

Under the Freedom of Information Act the authority must state whether or not the information exists and I confirm that we do not hold this information. 

The information that you have requested is for the Council to express an opinion regarding a hypothetical situation rather than factual information. The Council does not hold this information and, therefore, cannot provide this information in accordance with the Freedom of Information Act.

However, I can offer the following advice;

· The Council assesses each application for mandatory charitable rate relief on a case by case basis based on the fact pertaining to the organisation making the application

·   Rate relief is awarded where the circumstance meet the requirements for an award in accordance with section 43 of the Local Government Finance Act 1988

·  In making a determination the Council will give consideration to case law and any guidance issued by the Government
