Within The Transparency Code, it states ‘Local authorities must publish details of the value of social housing stock that is held in their Housing Revenue Account’.  The Council closed its Housing Revenue Account when it transferred its social housing stock to Bedfordshire Pilgrims Housing Association (bpha) in 1990 so there is no data relevant to your enquiry.

 I realize the Bedford Borough Council has recently distributed monies for the purpose of Excess Weight Prevention & Management.I would be most interested in receiving from you the full submitted bids (successful and unsuccessful) to allow me a better appreciation how the Council spends Public Health money

Under the provisions of the Freedom of Information Act, the authority must state whether or not the information exists and I confirm that we do hold the information you requested.

Following careful consideration, the Council has determined that part of the information requested to be disclosed comes within the terms of Section 43(2) of the FOI Act due to the likelihood of prejudice to the commercial interests of the third (3rd) parties who afforded this information to the Council as part of a competitive process. In line with Section 2 of the Act, the Council has to apply the public interest test for the purpose of establishing whether there is a public interest in the disclosure of the commercial information.

More specifically, with regards to the Bidders' technical submissions, the Council has determined that due to the short period of time that has elapsed since completion of the tender process for Contract ref. BBC203 (this was a joint commissioning between Bedford Borough Council and Central Bedfordshire Council), a disclosure of such technical proposals at this point in time would most likely weaken the Bidders' position in a competitive environment by revealing information of potential usefulness to their competitors. However, it is the Council’s view that disclosure of the tender documents, including but not limited to the specification, will provide the requestor with an insight of the Council’s strategic objectives and service requirements against which Bidders submitted their proposals. The relevant documents can be found attached to this letter.

With regards to the Bidders’ financial proposals, these were made in line with the affordability (budget) threshold that was set by the Councils in relation to Contract ref. 203. The overall threshold was set at £450,000 per annum. For further details on the financial modelling of the service, please refer to the attached Invitation to Tender document. Following application of the quality and price evaluation criteria, the process determined that the most economically advantageous tender was submitted by BeeZee Bodies who were awarded the contract. The total value of the contract is £1,415,751 (40% contribution from Bedford Borough) and the average cost per annum is £353,938 over a period of three (3) years and seven (7) months.

The average cost per annum across both Councils proposed by the remaining Bidders in no particular order were as follows:

Bidder A: £353,891.37 (59% Bedford Borough contribution)

Bidder B: £327,187.51 (40% Bedford Borough contribution)

Bidder C: £351,344.06 (36% Bedford Borough contribution)

Bidder D: £336,275.98 (35% Bedford Borough contribution)

The Council considers that the detailed breakdown of the above costings cannot be disclosed under the terms of Section 43(2) as such disclosure would prejudice the Bidders’ commercial interests by adversely affecting their position in a competitive environment and would diminish their negotiating position during contractual negotiations.

Response: Because we are talking about a range of different organisational structures as well as changing definitions of child sexual abuse over the years we do not think that there is any realistic prospect of us being able to provide a satisfactory answer to this question. Bedford Borough came into being in 2009 and our records only date back to then.

Prior to 2009 this information would have been held by and related to Bedfordshire County Council.  Bedfordshire County Council ceased to exist on 1 April 2009 when unitary councils were introduced across the whole of Bedfordshire. All services previously hosted by the County Council are now provided by either Bedford Borough Council or Central Bedfordshire Council depending on the area concerned. The topics of eligibility and wellbeing were raised in our first 2 Care Act Newsletters back in January and February.

We respect the professional capabilities of our staff and managers to make eligibility decisions based on assessment findings. We have provided classroom based learning for staff and online Me-Learning Modules cover the concept of Care Act Wellbeing.

Staff can access professional and line management supervision when unsure about ‘significant impact on wellbeing’. A multi-disciplinary Risk Panel is available for complex case advice. To date this has not been asked to comment on any areas of uncertainty around eligibility or wellbeing.

Service Users and/or Carers are given an Eligibility Statement after their assessment which is very clear about how the decision has been reached.
