With the number of university students in the village apparently declining, the Trustees are keen to support other initiatives. One that was discussed at our recent meeting was that of school transport for post-16 students.  Hence my query was about the level of cost for student living in Thurleigh to Sharnbrook, as our catchment area school, and any subsidies that might be available. I was also enquiring about the issue of transport if a student decides to go out of catchment e.g. Bedford 6th Form.

Finally, it would be helpful to know how many post-16 students in the village use school transport so that we can judge the potential level of demand on our funds.  I see this as being of possible benefit because it could reduce the need for students to be driven to Sharnbrook or, indeed, drive themselves, thus reducing pollution, congestion and possible accidents.

Answer:There are currently 10 young people of post statutory school age who reside in Thurleigh village who have been approved for subsidised transport to school or college for the 2014/15 academic year.  The subsidised fee for the 2014/15 academic year is £378.00 for the full academic year or £142.00 per term for three terms.  Students are entitled to a 50% discount of the costs of subsidised transport if their parent(s)/carer(s) are in receipt of Income Support, Income Based Jobseekers Allowance, Support from the National Asylum Support Service, Guaranteed Element of State Pension Credit or Child Tax Credit (provided that you are not entitled to Working Tax Credit and annual income does not exceed £16,190), or the maximum rate of Working Tax Credit.

 I am seeking to purchase an empty property which requires renovating. I understand you may have a list of empty properties, in the area.
Please can you advise me how I am able to obtain the list

Further to your request for information dated 2 February 2015, I can confirm that the information you requested is held under the Freedom of Information Act 2000. However, the Council, for the reasons that follow, declines to disclose the information requested.You requested:I am seeking to purchase an empty property which requires renovating.  I understand you may have a list of empty properties, in the area.  Please can you advise me how I am how to obtain the list.

Specifies, that the exemption in question is contained within Sections 40 and 31 of the FOI Act (FOIA).  An explanation follow below

On receiving your FOI request, legal advice has been taken and the Council has concluded that the information relating to properties where the Council Tax payer is an individual is confidential personal information that is exempt on the basis of Section 40 of the Freedom of Information Act.

The Council also considers that the information in relation to all the properties is exempt under Section 31 which is concerned with increased crime. The Council is particularly concerned about the high level of thefts of valuable metals and that publishing a list of empty properties will encourage thefts of this type.

Please can you tell me if your local authority is purchasing renewable energy, and if so how much?
It would be helpful if you could make the distinction between purchases and onsite renewables.Also, can you tell me if you have a renewable energy target, and if so how close you are to achieving it.

 Thank you for your request for information about renewable energy which we received on 4th February 2015. Your request has been considered under the Environmental Information Regulations 2004.  The information you requested is as follows:
Please find attached a chart which shows all of the sites that have renewable energy systems installed, which Bedford Borough Council currently receives the FIT for, and also details the systems’ ‘declared net capacity’ and ‘estimated annual generation’ – which both give an indication of the amount of ‘onsite renewables’ that we have installed as a council.
The Council does not ‘purchase’ this energy as such, but the sites use it to reduce their consumption of electricity from the grid.
A small amount of the electricity generated by the Hydro is used by the Embankment lighting. The remaining about of electricity is exported to the grid.
The Council has not set a renewable energy target.
In relation to the Council’s corporate contract for electricity which is currently through npower, all of the council sites will be offered/ supplied with green electricity from April 2015.

After the publication of the Report of Inspection of Rotherham Metropolitan Borough Council  what is Bedford Borough Council doing to ensure the safety of all the young people that live within the borough from sexual exploitation?

1. Is the Council taking steps to address any weaknesses and does it have the capability to do so?

2. Is the council taking steps to address weaknesses in Children’s Services and its work on CSE and does it have the capacity to continue to do so?

3. Does Bedford take and continue to take sufficient steps to ensure only ‘fit and proper persons’ are permitted to hold a taxi licence?

4. Does the Council take appropriate action against staff guilty of gross misconduct?

5. Does Bedford Borough Council cover up information and silence whistleblowers?

6. Does Bedford Borough Council have the resources to help young people who have been sexually exploited?

1.Answer: Bedford Borough Council is developing a Child Sexual Exploitation (CSE) Action Plan to underpin the current strategy.  The findings from Rotherham have been incorporated in to the Action Plan.  CSE is a priority for the Council and partner agencies. 

2. Answer: Children's Services are leading work on the Council wide Action Plan identified in question 1.  Funding has been agreed for an additional member of social work staff to increase the capacity within Children's Services.
3. Answer: Pursuant to Section 17 (1) of the Act the Council

Following careful consideration, I regret to inform you that we have decided not to disclose this information.

The information you requested is being withheld as it falls under the exception(s) in Regulation 13 of the Environmental Information Regulations 2004, as described below.

Regulation 12(3) says that if the information is personal data about someone other than the requester, the public authority cannot release it if it is exempt under regulation 13. The relevant parts of regulation 13 are as follows:

(1) To the extent that the information requested includes personal data of which the applicant is not the data subject and as respects which either the first or second condition below is satisfied, a public authority shall not disclose the personal data.

RE: Palgrave Rd Bedford

Can you please confirm whether worked carried out on the above has passed your satisfaction

I refer to your recent enquiry for information held by the Council relating to  Palgrave Road, Bedford. Your request has been considered under the Environmental Information Regulations 2004.Having consulted the records held within the Environmental Protection Division I would confirm the following:

• By virtue of Part IIA of the Environmental Protection Act 1990 the Council was required to formulate a Strategy to detail how it plans to meet its duty to inspect land in its area and identify contaminated land under sections 78B and C of the Act. This site is part of a larger site which is listed on our prioritised list of potentially contaminated sites, this is due to its historical use as an Iron Works. Due to the redevelopment and remediation of the land through the development control route, in line with current guidance this is the preferred route for the remediation of contaminate land, therefore no inspection is currently proposed. Therefore no reply given above refers to contaminated land for the purposes of the said Act. Similarly, unless otherwise noted, references to contamination should not be taken to mean the land has been deemed prejudicial to health or a nuisance for the purposes of Part III of the Act.

• The site was formerly part of the Brittania Iron Works site.
• As part of the redevelopment of the site, remediation works were carried out.

• These works were agreed with ourselves and the Environment Agency, the remediation was carried out in line with the requirements in place at the time.

• At this time we have no reason to suspect that the property is contaminated.

• Without prejudice to the above I would confirm that if you are aware of any past or present activity on the site which may have caused contamination you should consider arranging a specialist site survey.

• In addition, the information provided may be from incomplete records or information received from parties external of this Authority. Therefore the validity of the above information cannot always be guaranteed.

The data supplied has been obtained from the Department for Education (DfE) COLLECT Portal following the submission of Bedford Borough Council’s maintained schools Consistent Financial Reporting (CFR) returns for the financial years 2010/2011 to 2013/2014 (inclusive).

The data is the total spend for CFR codes E02 (Supply Teaching Staff) and E26 (Agency Supply Teaching Staff). This has been presented in an excel spreadsheet and contains the following detail as requested:

i) School DfE Number
ii) School Name
iii) E02 Direct Supply Spend Total
iv) E26 Agency Supply Spend Total

The School URN (Unique Reference Number) is not supplied as this is not included on the data downloaded from the COLLECT Portal. However, the DfE number is the schools’ unique identifier.

Further to your request for information dated 9 February 2015, I can confirm that the information you requested is held under the Freedom of Information Act 2000. However, the Freedom of Information Act 2000 does not oblige the Council to comply with a request for information if it estimates that the cost of complying with the request would exceed the “appropriate limit.”
This appropriate limit has been set in the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 which provides that for a local authority the appropriate limit is £450. This is calculated by reference to a maximum of 18 hours being taken and the cost of staff time being set in the Regulations as £25 per hour.  The Regulations also say that In calculating the amount the Council may, “for the purpose of its estimate, take account only of the costs it reasonably expects to incur in relation to the request in: (a) determining whether it holds the information, (b) locating the information, or a document which may contain the information, (c) retrieving the information, or a document which may contain the information, and (d) extracting the information from a document containing it.”

Further to your request for information dated 12 February 2015, I can confirm that the information you requested is held under the Freedom of Information Act 2000. However, the Council, for the reasons that follow, declines to disclose some of the information requested.You requested:1. How many council-owned properties are currently empty or derelict?Answer: There are currently 40 empty/derelict properties at the present time – this is subject to change at any time and several of the sites are subject to review or redevelopment and some are currently on the market for rent.

The Council is particularly concerned about the high level of thefts of valuable metals and that publishing a list of empty properties will encourage thefts of this type.
