The legislation to control dogs in public was approved by Government which gives Local Authorities the power to enforce.  However before enforcement can take place an advertisement needs to be placed in the local newspaper.

As a resident in Clapham I have a distinct interest in the Western By Pass works and how they impact on my daily commute and other journeys.
I understand that every competitive tender for such works have an technical submission which describes the way in which works are to be carried out and also the social outcomes that the contractor will deliver to the local area as part of his commitments to Bedfordshire Council.

1.What actions your council is taking or intends to take to ensure it complies with Clause 2.23 of the Care Act Statutory Guidance (“Developing a local approach to preventative support”) which requires a local authority to:
“…provide or arrange for services, facilities or resources which would prevent, delay or reduce individuals’ needs for care and support, or the needs for support of carers. Local authorities should develop a clear, local approach to prevention which sets out how they plan to fulfil this responsibility, taking into account the different types and focus of preventative support as described above. Developing a local approach to preventative support is a responsibility wider than adult care and support alone, and should include the involvement, by way of example, of those responsible for public health, leisure, transport, and housing services which are relevant to the provision of care and support.”
2.Relating to Clause 14 of the Care Act 2014 (“Power of local authority to charge), whether or not your council:
I.Currently charges carers for their own support, or;
II.Does not charge carers for their own support but intends to either introduce charges or consult or debate on the introduction of charges in the next 12 months, or;

Bedford Borough Council does not qualify for the Energy Saving Opportunity Scheme (ESOS). In accordance with item 1.2  of the ‘Complying with the Energy Savings Opportunity Scheme’ document (attached for your information), Bedford Borough Council is not currently required to participate in scheme.

In terms of other organisations in Bedford Borough that qualify for ESOS Assessments, unfortunately we do not hold a list which details this information. You would need to contact local companies directly to request this information. Alternatively, I would suggest you contact the regulator (Environment Agency) for the scheme to see if they can assist you.

Can you please let me know if the site above  or any within 250m are designated as contaminated land, or are scheduled for investigation under provisions of the EPA 1990 Part 2A.
I suspect not as we are doing the usual environmental and historical checks, and it doesn’t look to be particularly contentious, however our client is looking to acquire this site and so we just want to check from a liability perspective. There is no change in land use proposed.

Your request has been considered under the Environmental Information Regulations 2004.

I have consulted the records held by the Environmental Health and Trading Standards Department, and have answered your queries as follows:

By virtue of Part IIA of the Environmental Protection Act 1990 (‘The Act’), the Council was required to formulate a Strategy to detail how it plans to meet its duty to inspect land in its area and identify contaminated land under sections 78B and C of the Act. This site has not been determined as contaminated land under the Act.

Part of this site is listed on our prioritised list of potentially contaminated sites, as a former vehicle repair premises/ garage, and it will be assessed as part of our inspection arrangements. It is not possible to state when this assessment will be undertaken. At this stage, the Council is unable to state whether or not it expects this site to be identified as contaminated land because its inspection of land is in the course of completion.

There are a number of sites within 250m of this site, which have been identified as requiring inspection under the Act. These include any sites with potentially contaminative current or former uses, including a former

brewer and a former printer.

 Q1 : What is the reporting mechanism by which Azeus informs the council of new sales in the UK?

Our apologies for any misunderstanding as we are aware that Azeus Care have developed a relationship with Newham and very recently the Isle of Scilly.   We have regular Project Board meetings with Azeus and we will be informed by Azeus when the conditions under which Bedford benefits from the sale of the system to other authorities are met.  For example; we would not consider the system ‘sold’ until the point which the other authority has signed their’ certificate of satisfaction’ at which point they accept the system.   Beyond these details our arrangement is commercially sensitive and we would not provide any further details under section 43(2)  of the FOI Act.

The usual process for considering event proposals at Bedford is for them to be considered by our Events Advisory Group and take account of what can be achieved through temporary orders.  We would then progress the traffic regulation orders and event management arrangements in accordance with the outcome of those discussions.

What would be classed a social event,

We don’t generally use the term social event but this could be applied to a street party for the Royal Wedding or other such celebration. We have used Section 16a recently in relation to an Armed Forces Parade, a Fair, a Triathlon and a Graduates Procession – all of which could be described as ‘social’.

If an events company wanted to close part of the highways on public roads under section 16a of the act for a social event, on what grounds can they close the roads to pedestrians.

Generally with a road closure the footpath would remain open unless there was a specific health and safety reason why the footpath should close. Wherever possible access should be maintained for pedestrians and businesses etc.

Can an event company close area of the highway roads and then fence it off.  Then sell tickets to gain entry within the fenced of area if no money from ticket sales goes to a charity?

Technically yes, however it is unlikely we would allow this to happen. Within Bedford Borough there are a number of locations that could be closed off and managed for commercial use - like a park.  If the area to be closed off included premises then access to these premises would need to be maintained even if this required some form of control e.g. ticket or pass.

We would always need to allow access for any resident/business within a closed area again unless there was a specific health and safety reason. Any risk assessment prepared for the event would need to consider this prior to an event being given permission following scrutiny by the Event Advisory Group.  If management of access required some form of pass then eligibility for a pass might well be linked to a specific property and requiring some evidence. If there were safety reasons why the event arrangements included managed access to pedestrians then we would not expect exceptions to be made.

Assuming the event management arrangements have been approved, the events company would always have the right to stop or eject persons not having a ticket or other form of identification such as a residents pass or whatever had been agreed. Following a consultation in 2014, the government amended the Children and Young Person’s Act 2008 to allow social services functions related to children (with the exception of independent reviewing officer and adoption agency functions) to be delegated to not-for-profit third party providers. With this mind, I would like to request the following information under the Freedom of Information Act:

I have consulted the records held by the Environmental Health and Trading Standards Department, and have answered your queries as follows:

1.    By virtue of Part IIA of the Environmental Protection Act 1990 (‘the Act’), the Council was required to formulate a Strategy to detail how it plans to meet its duty to inspect land in its area and identify contaminated land under sections 78B and C of the Act. Based on information available at this time, it is not considered likely that the above site will be inspected under the Act. However, it is possible that new information may become available which could alter this assessment.

2.    We are not aware of any contamination issues associated with the site, or in the close vicinity. RE: the gas emissions the  factory.
I wish to make other Wixams residents aware that the plastic smell is not connected to the building work going on, as I’m sure many think this. The matter would be investigated under the statutory nuisance provisions contained within the Environmental Protection Act which would not require an analysis to be undertaken, it is sufficient to show that a statutory nuisance is being caused to local residents taking into account factors such as the frequency, duration and effect of the emissions.

The Council does not hold any data relating to the quantity of emissions released into the air in the last 12 months.

 I have the following question with regard to the proposed changes to the school system in North Bedfordshire:
1. Mayor Dave Hodgson states that the cost of changing the system from 3-tier to 2-tier will be £39M and the proposed implementation date is September 2017.  How has this £39M been calculated?
2. Allied to the above, where will savings be made in the existing budget(s) to 'free up' this £39M?
3. As it is likely that 1 or more of the Lower Schools will close, what will happen to their sites?  In particular, what discussions have taken place about Eileen Wade Lower School site if a move to a Primary School is not approved?

Under Freedom of Information Laws, I would like to find out details of incidents of reported sexual harassment and assaults involving children in maintained schools.

Since September 1, 2013 (to the date of this request), I would like to know the recorded numbers and available details of every incident of a child being involved in sexual harassment/assault /act in a school.

It is important the notes DO NOT contain the name of the people involved, or the name of the school involved. Providing either of these details might risk identifying someone potentially involved in criminal behaviour, or a victim of sexual offences.

However, it is crucial that the age and sex of the children involved are disclosed, along with any other details relating to the outcome of any disciplinary process which may have followed (for example suspension). Where applicable, please state if the case was treated as a child protection issue, with any of the children involved being deemed "at risk" or referred to children's services.

Providing these details will not lead to the identification of the child.

Incidents could include children being sexually bullied/harassed via online means (phones/computers). Assaults may be perpetrated by a young person on another, or by an adult (such as a member of staff).

This request is being sent to 150 local authorities with the view of examining the prevalence of sexual harassment/assaults in schools, nationally.

It may be that the council has no record of any incidents of this nature. Likewise, the council might not be responsible for running schools or social services in its area. In which case, please state this is the case and return the request.
