Planning Obligations

Planning obligations (S106 Agreements made under S106 of the Town and Country Planning Act 1990), are legally binding agreements entered into between a Local Authority and a developer. They provide the mechanism by which measures are secured to make the impact of development acceptable. This can be through financial contributions, works, activities or restrictions relating to the use of land and buildings. The use of planning obligations is a useful tool through which the Council can make development acceptable in planning terms that would otherwise be refused.

 

This Planning Obligations Supplementary Planning Document (SPD) sets out the Council’s policy for securing planning obligations from new developments that require planning permission and how this will change if the Council adopts a Community Infrastructure Levy (CIL). Planning obligations will then still be used to secure affordable housing and to mitigate site specific impacts. The SPD was adopted on 17 July 2013 following consultation and amendment. It replaces the former County Council’s Developer Contribution Strategy 2007.

 

The Planning Obligations SPD is a material consideration, having weight when considering planning applications for new development.

Section 106 Agreement Compliance Requests

If a Local Land Charge Search reveals an s106 Agreement, that s106 can be accessed on our Council’s website.  These are held with Planning Decision Notices via the following link: http://www.bedford.gov.uk/environment_and_planning/planning_town_and_country/search_plans_page.aspx .  Details on whether the obligations of that s106 have been complied with can be requested. A fee is required for this information; £62 (inc VAT) for up to the first hour taken to investigate compliance and a further £31 (inc VAT) per any additional part or whole hour taken.  An initial enquiry should be emailed to planning@bedford.gov.uk. A response will then be sent by email within two working days advising of the applicable fee (payment can be accepted from solicitors or clients in the form of a cheque made out to Bedford Borough Council or alternatively over the telephone with a debit card).  Once payment has been received a response is usually provided by email within 5 working days (longer time may be required depending on the complexity of a particular Agreement, the enquirer will be notified where this is the case).
