Licences and Permits

When undertaking work in, on or over the public highway within Bedford Borough it may be necessary for you to obtain approval from the Council before commencing your work. (Please note, the public highway includes the footway, carriageway and verge.)

Any approval will be granted by the Council in the form of licences/permits issued in accordance with the Highways Act 1980 and the New Roads and Street Works Act 1991.

Specifically, licences/permits are required if you want to:

  • Erect a scaffold or hoarding on the public highway.
  • Place a skip on the public highway.
  • Temporarily place building or other materials on the public highway.
  • Use a crane, scissor lift or cherry picker etc. on or over the public highway.
  • Place a projection over the public highway.
  • Construct a temporary access from the public highway.
  • Excavate in the public highway.

If your work will affect a parking bay or bays in the Controlled Parking Zone within Bedford central area, an application for the suspension of the bay(s) in question must be made to the Council's Parking Shop at least 14 working days in advance of the works. A charge will be made for the suspension of any bays. For more information please telephone the Parking Shop on 01234 718057 or email Parking.Shop@bedford.gov.uk.

Highway Projection Licences

Any display, temporary construction, or other equipment (e.g. canopies, blinds, CCTV equipment, hanging baskets) which may protrude or project over a public highway requires the issue of a licence. The Council is responsible for processing applications for a licence of this type.

The maximum depth that the display can protrude over the public footway is 1.05 metres, subject to 2.1 metres clear passageway between the edge of the projection and the kerb (or any intervening pavement furniture such as a bollard or telephone box).

The Council reserves the right, in exceptional circumstances, to allow a greater depth of display where the pavement is very wide, or a smaller depth of display where pedestrian footfall is very high.

All goods or equipment on display under the terms of the licence shall be kept within the area specified.

A minimum vertical clearance of 2.75 metres is required from the surface of the footway to the underside of any projection. This is to allow for the safe passage of pedestrians beneath projections of frontage development, such as canopies, blinds, CCTV equipment. The council may alter this vertical clearance in exceptional cases.

If at a future date pavement furniture is added by the council and the display area covered by the licence is affected, the licence will be reviewed or removed.
