Flyposting

Fly-Posting

Flyposting is the unauthorised placing of advertising - usually signs, posters or stickers, placed without the property owners consent. It is:

  1. Illegal and clearing it up costs the tax payers money
  2. Unsafe, as some types, particular placards and 'A' frames cause a danger to the public.  Some are placed on barriers at crossings causing a danger to children and road users.
  3. Unsightly, it indicates a neglected on both public and private property and increases the level and fear of crime
  4. A distraction to road users

 

Bedford Borough Council has powers under the Clean Neighbourhoods & Environment Act 2005, Environmental Protection Act 1990 and Town and Country Planning (Control of Advertisement) Regulations 1992 to enforce offences of this nature.

The Council is responsible for reducing and controlling flyposting in the Borough through education and enforcement. The Council will enforce the removal or remove any fly posters from public buildings, street furniture and monuments. Public utilities, e.g. telecoms and public transport operators, are responsible for removing flyposting from their property.  

 

What action does the enforcement team take?

  • the posters removed
  • the offender may be fined
  • warning letters will be sent
  • a formal caution will be issued
  • prosecutions will be made

 

Penalties

If you are found to be responsible for an act of Flyposting then a Fixed Penalty Notice (FPN) can be issued to discharge liability for the offence under the Anti Social Behaviour Act 2003. An offence can also be prosecuted through a Magistrate’s court.

What you need to do:

  • Tell us the exact location of the flyposting
  • Tell us what the flyposting is advertising
  • Provide any photographic evidence that you have
